Terms of use

The agreement between you and The Total Tubist when you use the app.

Effective date: [DATE TO BE SET AT LAUNCH]
Operated by: John DiCesare (support@thetotaltubist.com)

Agreeing to these terms

By creating an account or using The Total Tubist app or website, you agree to these terms and to our privacy policy. If you don’t agree, please don’t use the app.

Accounts and age

  • You need an account to use the app. Give accurate information, including whether you are 13 or older, and keep your password private.
  • You are responsible for what happens on your account.
  • If you are under 18, a parent or guardian should review these terms with you. Users under 13 can use the app but have no access to the community board.

Purchases and subscriptions

  • Apple handles billing. All purchases are made through the App Store and charged to your Apple ID. Apple’s terms also apply.
  • Basic is an auto-renewing subscription, billed monthly or yearly. New Basic subscribers get a 2-week free trial through the App Store, and the subscription starts billing when the trial ends unless you cancel at least 24 hours before. Participant is an auto-renewing subscription, billed monthly, every 6 months, or yearly. Pro is an auto-renewing subscription billed monthly. Each renews automatically at the same price unless you turn off auto-renew at least 24 hours before the end of the current period.
  • Cancelling: manage or cancel in your Apple ID settings (Settings › your name › Subscriptions). You keep your plan until the end of the period you’ve paid for. Deleting the app or your account does not cancel a subscription.
  • Refunds are handled by Apple under its policies. We can’t issue refunds directly.
  • We may change prices or what each plan includes. Price changes for subscriptions follow Apple’s notice rules, and you can cancel before they take effect.

Lessons and our content

The video lessons, masterclasses, lesson PDFs, excerpt practice tracks, text, and design in the app belong to The Total Tubist or to the faculty who created them. Your plan gives you a personal, non-transferable right to use them inside the app for your own study while your access lasts.

You may not copy, screen-record, download, share, sell, or publish lesson content, or use it to teach a paid course, without written permission. Teachers may use the app with their own students in a studio.

Your content

You own what you create: your recordings, markings, journal notes, and posts. Recordings stay on your device. My Music PDFs and your markings are stored in your private account so they sync between your devices. By posting on the community board, you give us permission to store and display your post to other members and to moderate it.

Only add music to My Music that you have the right to use.

Community guidelines

The community board is for Participant and Pro members aged 13 and up who want to talk tuba. Keep it a place where students of every background and level want to show up. These rules apply to every post, reply, and profile:

  • Zero tolerance for hate speech. Content that attacks people based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or age is removed, and the account that posted it may be suspended or banned without warning.
  • No harassment, bullying, threats, or sexual content.
  • Your own contact details are yours to share. You may post your own phone number or email address. Never post anyone else’s personal information without their permission.
  • No spam, scams, or misleading posts.
  • Don’t post lesson content, or other people’s recordings or music, without permission.
  • Be generous with feedback and honest without being cruel.

Posts are moderated. We may remove any post, and suspend or end any account, that breaks these guidelines or that we believe puts other members at risk. If you see a problem, tap … on the post and choose Report, or email support@thetotaltubist.com.

The For Sale board

The community board includes a For Sale board where members can list instruments, mouthpieces, music, and gear. The Total Tubist is not a party to any sale. We don’t inspect items, hold payment, verify sellers or buyers, or guarantee that a listing is accurate, and we are not responsible for any transaction, shipment, or dispute. Deal with care, meet or pay safely, and if you are under 18, involve a parent or guardian.

Using the app fairly

  • Don’t log practice time you didn’t play to climb a leaderboard.
  • Don’t try to get around plan limits, access other users’ data, or interfere with the app or its servers.
  • Don’t use the app for anything illegal.

Ending your account

You can delete your account at any time in Profile › Account › Delete account. We may suspend or close accounts that break these terms. If we discontinue the app, we will give reasonable notice.

Disclaimers and liability

The app is provided “as is.” We work hard to keep it accurate and running, but we can’t promise it will be free of errors or always available. Lessons are educational and are not a substitute for a teacher who can hear you in person. Device-only data such as recordings and PDFs can be lost if you delete the app or lose your device, so keep your own copies of anything important.

To the extent the law allows, The Total Tubist is not liable for indirect or consequential damages, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. [Lawyer: review limitation of liability wording.]

Changes, law, and contact

We may update these terms. We’ll change the effective date above and tell you in the app before major changes take effect. These terms are governed by the laws of the State of Washington, United States.
